This class action was filed on behalf of non-exempt service technicians who worked at the service centers at Dublin Toyota, Dublin Fiat, Dublin Scion, Dublin Nissan, Dublin Hyundai, and/or Dublin Volkswagen at any time during the period of October 13, 2012 through August 28, 2018. The workers seek damages and penalties for missed meal and rest periods, unpaid wages, including off the clock work and overtime, and derivative violations of the California Labor Code. The workers allege that their employers’ piecerate and production bonus compensation policies deprived them of straight and overtime wages, that they were not authorized or permitted to take off-duty rest breaks, and they were not provided off-duty meal breaks, along with other related claims. Defendants deny that they violated any laws, and assert that the workers were paid all wages owed to them and that they took all of the breaks to which they were entitled.
The Court has granted preliminary approval and scheduled a hearing to consider the workers’ motion for Final Approval of the settlement on December 18, 2018, at 3:00 p.m. The Court’s preliminary approval order and other relevant documents can be viewed below:
